Terms and Conditions (Host)

These Host Terms and Conditions (“Host Terms”) govern the listing, management, and provision of accommodation by Hosts through the LibraX platform. They form part of the legally binding agreement between you (“Host,” “you,” or “your”) and LibraX Technologies Limited (“LibraX,” “we,” “our,” or “us”). These Host Terms are to be read together with the LibraX General Terms and Conditions of Service, the Privacy Policy, the Host Cancellation Policy, the Conflict Resolution Policy, and any other LibraX policies (collectively, the “Platform Policies”). Where these Host Terms and the General Terms conflict on a matter specific to Hosts, these Host Terms prevail to the extent of that inconsistency. By registering as a Host, creating or publishing a Listing, accepting a Booking, or otherwise using the Platform as a Host, you acknowledge that you have read, understood, and agree to be bound by these Host Terms and the applicable Platform Policies.
Definitions
In these Host Terms, the following definitions apply in addition to those in the LibraX General Terms and Conditions:
- Host: any individual or corporate entity that lists Accommodation on the LibraX Platform, including property owners, letting agents, and property managers.
- Guest: a User who searches for, requests, or books Accommodation through the Platform.
- Accommodation: any apartment, villa, hotel room, guesthouse, or other lodging listed on LibraX.
- Listing: a property profile created by a Host on the Platform describing the Accommodation, its features, pricing, availability, and house rules.
- Host Payout: the amount disbursed to the Host following a Confirmed Booking, after deduction of the LibraX commission and any applicable charges.
- Commission: LibraX’s fee deducted from each booking as consideration for access to the Platform and payment infrastructure.
- Settlement: the process by which LibraX releases the Host Payout to the Host following a Confirmed Booking.
- Host Cancellation Fee: the fee payable by a Host for cancelling a Confirmed Booking, as set out in the LibraX Host Cancellation Policy.
Nature of the Platform
LibraX is an online technology marketplace that enables Hosts to advertise Accommodation and facilitates bookings between Hosts and Guests. LibraX does not own, lease, manage, control, operate, endorse, or provide the Accommodation listed on the Platform.
A booking made through the Platform creates a direct contractual relationship between the Host and the Guest. Except as expressly provided in these Host Terms or the LibraX General Terms and Conditions, LibraX is not a party to the accommodation contract between a Host and a Guest.
The Host acknowledges that LibraX acts solely as an intermediary technology platform and payment facilitator and is not an estate agent, hotel operator, travel agency, property manager, or accommodation provider.
The Host remains solely responsible for the Accommodation offered, the services provided to Guests, compliance with all applicable laws, and the accuracy of all information contained in the Listing.
Host Eligibility and Onboarding
To list on LibraX, you must meet all of the following requirements:
- Age and capacity: you must be at least 18 years old and possess full legal capacity to enter into a binding contract.
- Proof of authority: you must provide proof of ownership of the listed property or written authorisation from the property owner to list and manage the property on their behalf.
- Corporate hosts: corporate entities must provide valid business registration documents (CAC Certificate of Incorporation and related documents) and evidence of authority of the individual acting on behalf of the entity.
- Identity verification: all Hosts must complete identity verification through LibraX’s designated provider. Verification results are retained in accordance with the LibraX Privacy Policy.
- Physical verification: all properties must pass a physical property verification process conducted by or on behalf of LibraX before any Listing goes live on the Platform.
- Regulatory compliance: you must hold all licences, permits, and regulatory approvals required by applicable law for the short-term letting of your property, including any required from local government authorities, estate management associations, or property regulators.
Compliance with the onboarding requirements does not guarantee approval to list on the Platform. LibraX reserves the right, in its reasonable discretion, to approve, reject, suspend, or remove any Host application or Listing where it reasonably considers such action necessary to protect the integrity, reputation, security, or lawful operation of the Platform.
On-going verification: LibraX may, at any time during the Host’s use of the Platform, require the Host to provide updated identification documents, proof of ownership or authority, regulatory approvals, licences, or any other information reasonably required to verify continued compliance with these Host Terms. Failure to provide the requested information within the prescribed period may result in suspension of the Listing or the Host’s account.
Formation of Booking Contract
A confirmed booking made through the Platform creates two distinct contractual relationships:
- a contract between LibraX and each User governing the use of the Platform in accordance with the General Terms and Conditions; and
- a separate and legally binding accommodation agreement between the Host and the Guest governing the provision and use of the Accommodation.
The accommodation agreement is formed upon confirmation of the booking and comprises the applicable Listing, the Host’s disclosed house rules, the booking confirmation, these Host Terms, and the General Terms and Conditions, to the extent applicable.
LibraX facilitates the formation of the accommodation agreement by providing the Platform and payment infrastructure but is not a party to that agreement and does not assume the obligations of either the Host or the Guest arising from it, except as expressly provided in these Terms or the General Terms and Conditions.
Without limiting the foregoing, the Host is solely responsible for the Accommodation, including its condition, safety, legality, availability, and the accuracy of the Listing, while the Guest is solely responsible for complying with the accommodation agreement, the Host’s disclosed house rules, and all applicable laws during the stay.
Listing Standards and Accuracy
By submitting a Listing, you represent and warrant to LibraX and to prospective Guests that:
- All information in your Listing is accurate, complete, and not misleading, including property type, location, size, number of bedrooms, maximum occupancy, and available amenities.
- All photographs and media used in the Listing are genuine, current, and accurately reflect the condition and appearance of the property.
- The property is safe, habitable, and fit for the purpose described.
- All utility and facility claims (electricity, water, internet, parking, pool, generator backup, etc.) are accurate and available as described.
- The stated location coordinates and address are correct.
You must update your Listing promptly whenever any material information changes. LibraX reserves the right to suspend or remove any Listing found to be inaccurate, misleading, or non-compliant with these Host Terms.
House Rules
Hosts may establish reasonable house rules applicable to Guests during their stay. All house rules must:
- be clearly disclosed before a booking is confirmed;
- comply with all applicable laws;
- not be discriminatory or unfair; and
- not conflict with these Host Terms or the LibraX General Terms and Conditions.
Hosts shall not enforce undisclosed house rules against Guests after a booking has been confirmed.
Host Obligations
As a Host on LibraX, you are solely responsible for the accommodation services you provide. You agree to:
- Maintain the property: ensure the Accommodation is clean, safe, habitable, and in the condition described in your Listing at the time of each Guest’s check-in.
- Respond promptly: respond to Booking Requests within the time specified by LibraX. Failure to respond causes the request to expire and may affect your listing visibility.
- Provide access: provide clear check-in instructions to confirmed Guests and remain reachable during their stay for reasonable queries and emergencies.
- Honour confirmed bookings: you must not cancel a Confirmed Booking except in verifiable circumstances beyond your reasonable control. Repeated or unjustified cancellations may result in listing suspension or account termination.
- No pressure to cancel: you must not encourage, pressure, or incentivise a Guest to cancel a Confirmed Booking. This constitutes a serious violation and may result in the Host Cancellation Fee being applied as if you cancelled.
- Report damage promptly: if a Guest causes damage or violates house rules, you must report this to LibraX within the timeframe specified in the LibraX Conflict Resolution Policy, with supporting photo or video evidence.
- Comply with laws: you must at all times comply with all applicable laws, including laws on short-term letting, zoning, health and safety, consumer protection, and data privacy.
- Taxation: you are solely responsible for all taxes arising from your hosting activities, including income tax, VAT (where applicable), and any relevant local levies. LibraX does not withhold or remit taxes on your behalf unless required by law.
- Illegal activities: the Host shall not knowingly permit the Accommodation to be used for any unlawful, fraudulent, or criminal activity, including money laundering, human trafficking, prostitution where prohibited by law, the manufacture or distribution of prohibited substances, cybercrime, or any activity that may expose LibraX to legal or reputational risk. LibraX may immediately suspend or terminate the Host’s account upon becoming aware of such activity.
Fraud and Platform Integrity
The Host shall not engage in any fraudulent, deceptive, misleading, or abusive conduct on the Platform, including creating fake Listings, submitting forged documents, manipulating reviews or ratings, creating multiple accounts to circumvent Platform policies, or engaging in booking manipulation or payment fraud. LibraX may immediately suspend or terminate the Host’s account where it reasonably suspects such conduct.
Utility and Habitability Standards
Because infrastructure varies across Nigeria, LibraX sets minimum utility and habitability standards that all listed properties must meet. You must ensure your property complies with the standards you have advertised.
- Electricity: if your Listing advertises electricity or backup power, you must provide a functional power supply or generator/inverter. Prolonged or repeated outages that are within your control and are not disclosed to the Guest may constitute a service failure.
- Water: you must provide a reliable supply of usable water. Prolonged absence of water may constitute a service failure.
The Host shall ensure that each Accommodation is maintained in a reasonably safe condition and complies with applicable health and safety requirements. Without limitation, the Host shall ensure that emergency exits are accessible, electrical installations are reasonably safe, security measures are functional, and any safety equipment advertised in the Listing is available and operational.
Consequences: where LibraX determines that a utility or habitability failure is attributable to you, the Guest may be entitled to compensation credits, partial refunds, or full refunds. All such compensation will be deducted from your Host Payout.
Ratings and Reviews
Guests may submit reviews and ratings following completed bookings. LibraX reserves the right to remove or moderate reviews that are fraudulent, abusive, defamatory, misleading, irrelevant, or otherwise violate these Terms or applicable law. LibraX is under no obligation to remove a review solely because a Host disagrees with its content.
Pricing, Payouts, and Settlement
- Pricing: you set your own nightly rate in Nigerian Naira (NGN). LibraX displays this rate to Guests alongside the Booking Fee and Caution Fee. You are responsible for ensuring your pricing complies with applicable consumer protection laws.
- Commission: LibraX deducts its commission from each booking before disbursing your Host Payout. The applicable commission rate is communicated to you during onboarding and may be updated from time to time with reasonable notice.
- Settlement timeline: your Host Payout is released after the Guest checks in, subject to no active dispute. Settlement is processed by our payment service provider (Paystack). LibraX does not itself hold Host funds.
- Deductions: LibraX may deduct from your Host Payout any Host Cancellation Fees, compensation credits awarded to a Guest, or other amounts owed by you under these Host Terms.
- Taxes: Host Payouts are disbursed gross. You are solely responsible for declaring and remitting all applicable taxes.
- Double bookings: the Host shall maintain an accurate availability calendar and shall take reasonable steps to avoid double-booking the Accommodation. Where a confirmed booking cannot be honoured due to double-booking or inaccurate calendar management, LibraX may treat the incident as a Host cancellation and apply the Host Cancellation Policy.
Chargebacks, Payment Reversals and Recovery
For the purposes of these Host Terms, a “Chargeback” means any reversal, chargeback, retrieval request, payment dispute, adjustment, withholding, or deduction of a payment initiated or effected by a Guest, a card issuer, issuing bank, payment service provider, payment scheme, financial institution, or any competent authority in respect of a booking made through the Platform.
The Host acknowledges and agrees that payments made in respect of bookings may, in certain circumstances, be reversed, disputed, withheld, declined, or charged back by a Guest, a payment service provider, a card issuer, an issuing bank, a payment scheme, or any competent financial institution, notwithstanding that settlement may already have been made to the Host.
Where a Chargeback or payment dispute arises, the Host shall promptly cooperate with LibraX and any payment service provider engaged by LibraX by providing all information and supporting documentation reasonably requested to investigate or respond to the Chargeback within [TIMEFRAME TO BE CONFIRMED] of being notified of the Chargeback.
Failure by the Host to provide the requested information within the prescribed period may adversely affect LibraX’s ability to challenge the Chargeback and shall result in LibraX recovering the disputed amount from the Host.
Where a payment relating to a booking is under investigation or has been disputed, LibraX may suspend or delay settlement of the corresponding Host Payout until the Chargeback or payment dispute has been resolved.
Where LibraX incurs any loss, liability, charge, penalty, fee, cost, deduction, withholding, refund, reversal, or other expense arising from a Chargeback attributable to the Host’s acts, omissions, conduct, representations, or breach of these Host Terms or the accommodation services provided by the Host, the Host shall immediately reimburse LibraX for: (i) the full amount of the Chargeback; (ii) any amount issued in connection with the relevant booking; (iii) any processing fees, penalties, administrative charges, fines, or costs imposed by LibraX’s payment service provider or financial institution, card scheme, or regulatory authority in connection with the Chargeback; and (iv) any reasonable legal or recovery costs incurred by LibraX arising directly from the Chargeback.
LibraX may recover any amount due under this Clause by:
- deducting the amount from any current or future Host Payouts;
- setting off the amount against any sums otherwise payable to the Host;
- invoicing the Host for immediate payment;
- debiting any reserve or security balance maintained by LibraX (where applicable); or
- pursuing any other lawful means of recovery.
LibraX shall not be obliged to contest, defend, or appeal every Chargeback. LibraX may, acting reasonably and having regard to the available evidence, the applicable payment scheme rules, the requirements of its payment service provider, applicable law, and the commercial viability of pursuing the matter, determine whether to dispute or accept a Chargeback.
Where LibraX reasonably determines that a Host has generated an excessive number or value of Chargebacks, refunds, payment disputes, or suspected fraudulent transactions, LibraX may suspend settlements, suspend or terminate Listings, require additional verification, impose additional monitoring measures, or terminate the Host’s account in accordance with these Host Terms.
The rights and obligations contained in this Clause shall survive the suspension, termination, or expiration of these Host Terms and shall continue to apply in respect of any Chargeback, dispute, reversal, refund, or adjustment relating to a booking completed before such suspension, termination, or expiration.
Host Cancellation Policy
If you cancel a Confirmed Booking, cancellation fees apply. The applicable fee depends on the timing of the cancellation and the length of the stay. Full details are set out in the separate LibraX Host Cancellation Policy, which is incorporated into these Host Terms by reference.
Additional consequences of Host cancellation:
- You receive no Host Payout for the cancelled reservation.
- The listing calendar may be blocked for the affected dates.
- Repeated or unjustified cancellations may lead to listing suspension or permanent account termination.
Fee waiver: a Host Cancellation Fee may be waived only in documented circumstances proven to be genuinely beyond your reasonable control (such as force majeure events, structural damage, or verified emergencies), supported by evidence satisfactory to LibraX. Even where a fee is waived, no Host Payout is disbursed for the cancelled reservation.
Listing Suspension and Removal
LibraX may suspend or remove a Listing, with or without prior notice, on any of the following grounds:
- The Listing contains inaccurate, misleading, or fraudulent information.
- The property fails to meet LibraX’s minimum habitability or utility standards.
- The Host has received repeated verified complaints from Guests.
- The Host is found to have pressured Guests to cancel or to circumvent LibraX’s payment system.
- The Host has failed to comply with applicable laws, including licensing or regulatory requirements.
- LibraX is required to remove the Listing by law, regulation, or court order.
Suspension or removal of a Listing does not automatically terminate your LibraX account. However, serious or repeated violations may result in full account termination under the General Terms.
Representations and Warranties
By listing on LibraX, you represent and warrant that:
- You have the legal right and authority to list the property and provide accommodation services.
- The property complies with all applicable health, safety, and habitability laws and regulations.
- You hold (or will hold prior to going live) all licences and permits required by law for short-term accommodation letting.
- You will comply with all applicable data protection laws in respect of any Guest personal data you receive in connection with a booking.
- You will not discriminate against any Guest on the basis of race, ethnicity, religion, gender, disability, national origin, sexual orientation, or any other protected characteristic under Nigerian law.
Insurance
The Host is responsible for obtaining and maintaining any insurance required by law or reasonably necessary for the operation of the Accommodation, including property insurance, public liability insurance, and any other applicable insurance. LibraX does not provide insurance coverage for the Accommodation, the Host, or the Host’s property unless expressly stated otherwise. The Host acknowledges that the absence of insurance shall not impose any liability on LibraX for loss or damage suffered by the Host.
Intellectual Property
You retain ownership of photographs, descriptions, and other content you upload to your Listing. By submitting content to LibraX, you grant LibraX a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, and promote that content on the Platform and in LibraX marketing materials for the purpose of advertising your Listing. This licence terminates when your Listing is permanently removed from the Platform.
Confidentiality
During the Host’s use of the Platform, the Host may receive or have access to confidential or proprietary information relating to LibraX, Guests, or other Hosts, including business information, pricing methodologies, software, platform features, security procedures, operational processes, Guest information, and any other information designated as confidential or which ought reasonably to be regarded as confidential (“Confidential Information”). The Host shall:
- keep all Confidential Information strictly confidential;
- use such Confidential Information solely for the purpose of performing its obligations under these Host Terms and providing Accommodation through the Platform;
- not copy, disclose, publish, reproduce, sell, licence, or otherwise make the Confidential Information available to any third party except with LibraX’s prior written consent or where required by applicable law; and
- implement appropriate administrative, physical, and technical safeguards to protect Confidential Information from unauthorised access, disclosure, alteration, or loss.
The Host shall ensure that its employees, contractors, representatives, and agents who require access to Confidential Information are bound by confidentiality obligations no less restrictive than those contained in these Host Terms.
The obligations under this Clause shall not apply to information which: (a) is or becomes publicly available through no breach of these Host Terms; (b) was lawfully in the Host’s possession before disclosure by LibraX; (c) is lawfully obtained from an independent third party without any obligation of confidentiality; or (d) is required to be disclosed by a court of competent jurisdiction or applicable law, provided that, where legally permissible, the Host gives LibraX prompt written notice before such disclosure.
Upon suspension or termination of the Host’s account, or upon LibraX’s written request, the Host shall promptly cease using and, where reasonably practicable, return or securely destroy any Confidential Information in its possession, except where retention is required by applicable law.
Data Protection — Guest Personal Data
In the course of a Booking, LibraX may share with the Host certain Guest personal data reasonably necessary to enable the Host to fulfil the accommodation agreement (including for check-in and stay administration). The categories of Guest personal data shared with the Host, and the purposes for which they may be shared, are as set out in the LibraX Privacy Policy.
In respect of any Guest personal data the Host receives under these Host Terms, the Host acts as an independent data controller and not as a processor, sub-processor, or agent of LibraX. The Host is solely responsible for its own compliance with the Nigeria Data Protection Act 2023 and any other applicable data protection law in respect of that data. The Host shall:
- use Guest personal data solely for the purpose of fulfilling the relevant Booking, and for no other purpose, including marketing, profiling, or onward transfer to a third party, without the Guest’s separate, informed consent;
- implement appropriate technical and organisational measures to protect Guest personal data against unauthorised access, loss, or disclosure;
- retain Guest personal data only for as long as reasonably necessary for the purpose for which it was shared, and securely delete or anonymise it thereafter; and
- notify LibraX without undue delay if the Host becomes aware of any actual or suspected unauthorised access to, or loss or disclosure of, Guest personal data, to enable LibraX to meet its own obligations (including any regulatory notification obligations) under the NDPA.
Nothing in this Clause makes LibraX a joint controller with the Host in respect of the Host’s own subsequent use of Guest personal data, and the Host shall indemnify LibraX in accordance with the Indemnification Clause for any loss arising from the Host’s breach of this Clause.
Indemnification
The Host agrees to indemnify, defend, and hold harmless LibraX, its affiliates, directors, officers, employees, agents, successors, and assigns (collectively, the “Indemnified Parties”) from and against any and all claims, actions, proceedings, liabilities, losses, damages, fines, penalties, costs, and expenses (including reasonable legal fees and professional costs) arising out of or in connection with:
- the Host’s breach of these Host Terms, the General Terms and Conditions, or any other applicable LibraX policy;
- the Host’s breach of the accommodation agreement entered into with a Guest;
- any negligent, reckless, fraudulent, unlawful, or wilful act or omission of the Host or the Host’s employees, contractors, agents, representatives, or persons acting on the Host’s behalf;
- any claim arising from the ownership, management, occupation, condition, maintenance, safety, habitability, or use of the Accommodation;
- any inaccuracy, omission, misrepresentation, or misleading statement contained in the Listing or any other information supplied by the Host through the Platform;
- the Host’s failure to obtain or maintain any licence, permit, consent, approval, registration, insurance, or other authorisation required under applicable law;
- any death, personal injury, property damage, theft, loss, or other harm occurring at or in connection with the Accommodation, except to the extent directly caused by the gross negligence or wilful misconduct of LibraX;
- any claim by a Guest or any third party arising from the Accommodation or the services provided by the Host;
- the Host’s infringement or alleged infringement of any intellectual property right, privacy right, or other proprietary right arising from any content, photographs, descriptions, trademarks, or other materials uploaded to the Platform;
- any breach by the Host of applicable laws, including laws relating to consumer protection, health and safety, taxation, anti-money laundering, sanctions, data protection, planning, zoning, hospitality, or short-term letting;
- any Chargeback, refund, payment dispute, processing fee, penalty, or other payment-related liability arising from the Host’s acts or omissions, including the Host’s failure to honour a confirmed booking or to provide the Accommodation substantially as described.
Limitation of Liability
To the fullest extent permitted by applicable law, LibraX shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, goodwill, business opportunities, anticipated savings, or data arising from or relating to the Host’s use of the Platform.
LibraX shall not be responsible for: (a) the acts or omissions of any Guest; (b) theft, loss of, or damage to the Host’s property; (c) personal injury occurring at the Accommodation; (d) interruptions in utility services not caused by LibraX; (e) the conduct of third-party payment processors; (f) delays in settlement caused by banks, payment processors, regulatory requirements, or events beyond LibraX’s reasonable control.
To the fullest extent permitted by applicable law, LibraX’s aggregate liability arising out of or in connection with these Host Terms shall not exceed the total amount of commissions, service fees, or other amounts received by LibraX from the Host during the three-month period immediately preceding the occurrence of the event giving rise to the claim.
Force Majeure
Neither LibraX nor the Host shall be liable for any delay or failure in performing its obligations under these Terms to the extent such delay or failure results from a Force Majeure Event.
For the purposes of these Terms, a Force Majeure Event means any event beyond the reasonable control of the affected party, including acts of God, flood, storm, fire, epidemic, pandemic, earthquake, war, terrorism, civil unrest, riot, labour disputes (excluding those affecting only the affected party’s workforce), governmental action, changes in law, court orders, internet or telecommunications failure, prolonged power grid failure, cyberattacks, payment network failures, or any other event that could not reasonably have been prevented or avoided.
Where a Force Majeure Event prevents a Host from honouring a Confirmed Booking, the Host shall promptly notify LibraX and the affected Guest and provide reasonable supporting evidence where requested. LibraX may waive any applicable Host Cancellation Fee where it is satisfied that the cancellation resulted directly from the Force Majeure Event.
Where a Force Majeure Event materially affects the operation of the Platform, LibraX may suspend bookings, delay settlements, suspend Listings, or take such other reasonable measures as may be necessary to protect the Platform, Hosts, Guests, or applicable payment systems.
Governing Law
These Terms shall be interpreted and governed in accordance with the laws of the Federal Republic of Nigeria.
Dispute Resolution
Where any dispute arises between LibraX and a Host in connection with these Terms, the affected party shall first notify the other party of the dispute and the parties shall use reasonable efforts to resolve the dispute through good-faith discussions within thirty (30) days.
Where the dispute remains unresolved after the negotiation period, either party may refer the dispute to mediation administered by the Lagos Multi-Door Courthouse (LMDC) or such other mediation institution as the parties may agree. Participation in mediation shall not prevent either party from commencing arbitration if the dispute is not resolved.
Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, interpretation, performance, breach, or termination, which is not resolved through amicable negotiations or mediation, shall be finally resolved by arbitration administered by the Lagos Court of Arbitration in accordance with its applicable Rules and the Arbitration and Mediation Act, 2023.
The tribunal shall consist of one arbitrator appointed by agreement of the parties or, failing agreement, by the Lagos Court of Arbitration in accordance with its Rules. The arbitral award shall be final and binding on the parties and may be recognised and enforced by any court of competent jurisdiction. The seat of the arbitration shall be Lagos, Nigeria.
Nothing in this Clause prevents either party from seeking interim or conservatory relief from a court of competent jurisdiction where such relief is necessary to preserve assets, confidential information, evidence, intellectual property rights, or the status quo pending the determination of the dispute.
Disputes between a Host and a Guest relating to the accommodation agreement shall first be referred to LibraX under the Conflict Resolution Policy. LibraX may facilitate communication, review evidence, administer the Caution Fee, determine eligibility for Platform protections or refunds, and make decisions in accordance with its published policies. Where the dispute is not resolved through the Platform’s dispute resolution process, either party may pursue any remedies available under applicable law. LibraX’s involvement in facilitating the dispute does not make it a party to the accommodation agreement or constitute legal representation of either party. Where LibraX facilitates such resolution, it does so as operator of the Platform and is not a party to the accommodation contract.
Amendments
LibraX reserves the right to change, revise, or modify these Terms from time to time by updating this page. The changes will not be retroactive, and the most current version of the Terms will always be on this page and will continue to govern our relationship with you. We will also endeavour to notify you of any material changes, which could be done via email associated with your account or an in-app message. By continuing to use our Services after the changes become effective, you agree to be bound by the revised Terms.
Miscellaneous
Relationship: nothing in these Host Terms creates a partnership, employment, agency, or joint venture relationship between LibraX and any Host. Hosts are independent contractors.
Severability: if any provision of these Host Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force.
Entire agreement: these Host Terms, together with the LibraX General Terms and Conditions of Service, the LibraX Host Cancellation Policy, the LibraX Guest Cancellation Policy, the LibraX Conflict Resolution Policy, and the LibraX Privacy Policy, constitute the entire agreement between LibraX and the Host with respect to the listing and provision of accommodation on the Platform.
Survival: any provision of these Terms which by its nature is intended to survive termination shall remain in full force and effect following the termination or expiration of these Terms, including provisions relating to intellectual property, limitation of liability, indemnity, dispute resolution, governing law, and any rights or remedies arising prior to termination.
